1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely HH Vikramsingh being Executor named under the Will of deceased. The deceased namely Raja Digvijaysingh died at Ratlam, Madhya Pradesh on 23.01.1990. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 11.01.2026 for non-availability of identification proof of deceased which is annexed to the petition. The same is accepted.

2. The deceased left behind his last Will and Testament which was duly executed at Indore, Madhya Pradesh on 08.11.1985. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the Executors and another executor namely Maharajkumar Jaysingh died as stated in para No. 5 of the petition. Residuary clause in respect of properties of deceased is mentioned at para No. 9, 16 and various other clauses of the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. One son of deceased namely Jaysingh died as bachelor. Daughter of deceased namely Vijayalaxmi died leaving behind one son and one daughter. Another daughter of deceased namely Devayani died leaving behind her one son and two daughters. Deceased is survived by one son, three daughters, two grandsons and three granddaughters. Out of them son is petitioner herein and all other legal heirs have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Petitioner has filed Affidavit dated 24.03.2026 stating therein that the original Attesting Witnesses to the Will have expired therefore, petitioner has filed Affidavit of one N. K. Chaudhary dated 22.11.2025 in compliance of provisions of Rule 384 of the Bombay High Court ......2

SLG -- 2 -- (Original Side) Rules, 1980 and as per order dated 17.04.2026 passed by this Hon'ble Court. Affidavit of Service of General Citation dated 24.03.2026 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as per para No. 4 of the order dated 17.04.2026 pased by this Hon'ble Court and after verifying whether any cross petition is filed or whether any caveat is filed.
