Present Misc. Petition is filed by Petitioner for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased Pallavi Manoj Shirodkar. The names and details of legal heirs of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph No.7 of the Petition. I have perused the same.

Joint consent affidavit dated 09.12.2025 of Kshitij Manoj Shirodkar and Anuj Manoj Shirodkar, the legal heirs of the deceased are appended to page No. 33 of the Petition.

In view of the above, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clauses 'A' and 'B' which read thus:- "A) This Hon'ble Court be pleased to issue a Legal Heirship Certificate to the Petitioner under the provision of Bombay Regulation VIII of 1827 certifying that Manoj Kashinath Shirodkar and he be declared as legal heir and legal representative of the deceased Pallavi Manoj Shirodkar under the provisions of Bombay Regulation Act VIII of 1827. B) The delay in Filing the Legal Heirship Certificate shall be condoned because the Legal Heirship Certificate is required for the closure of the HDFC Bank Loan of Shirodkar Polymer having its office at Gala No. 51 in which the deceased Pallavi Manoj Shirodkar is the 50% Coborrower with the Petitioner furthermore had mortgaged Gala No. 13 for the same and SBI Overdrafi facility to V. K. Rubber Industries having its office at Gala No. 50 in which the deceased Pallavi Manoj Shirodkar is the 50% owner and member under the Banking and Regulation Act. 1949." 6.

Issuance of proclamation stands dispensed with. 7.

Department is directed to issue the legal heirship certificate as directed above within a period of 3 weeks from today positively. 8.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
