Heard Mr. Logade, learned Advocate for Petitioner. 2.

In view of the averments made in paragraph No.8 of the Petition notifying that the Executors have sought 50% share in the property and credits of the deceased in order to act as Executors. Considering the fact that Executors are not the beneficiary and therefore there can be no impediment in allowing the present Misc. Petition.

In view of the above, Misc. Petition stands allowed in terms of prayer clauses (a) and (b).

Needless to state that Petitioner will take steps in accordance with law as available to Petitioner for all due compliances for issuance of Grant from the Department.
