Heard Mr.Ravi Chidurala, learned Counsel for the Petitioner. 2.

By this petition filed under the provisions of Bombay Regulation VIII of 1827, the Petitioner seeks issuance of legal heirship certificate in favour of the surviving legal heirs of the deceased.

The deceased was the father of the Petitioner who expired on 20th February 2025. A copy of his death certificate is annexed to the petition as Exhibit-A. It is stated that at the time of his demise, the deceased was residing and had a fixed place of abode at C-1, 3rd Floor, Plot 447, Anjali Co-op. Hsg. Society, Baburao Parulekar Marg, B.S.Road, Dadar, Gr.Mumbai, Maharashtra-400 028. It is also stated that the deceased died intestate without leaving behind any testamentary writing or will. 4.

In paragraph 4 of the petition, the Petitioner has given details of the surviving MANISH SURESHRAO THATTE Date: 2026.06.16 16:24:42 +0530 MANISH SURESHRAO THATTE legal heirs of the deceased namely wife, one son and two daughters. It is specifically stated that the parents of the deceased have predeceased him. M.S.Thatte

The petition also annexes the consent affidavits of the wife of the deceased and two daughters of the deceased, who have given their no objection to the grant of legal heirship certificate in favour of the Petitioner, without service of proclamation/citation/notice upon them and have accorded their full and free consent to the same.

It is stated that the legal heirship certificate is required to be produced before the Collector of Mumbai, the Slum Rehabilitation Authority and the Co-operative housing society at Mumbai in order to complete legal formalities so as to enter the name of the Petitioner and other legal heirs of the deceased in all the official records. 7.

It is stated that no other petition for heirship certificate, succession certificate, probate or letters of administration with or without Will have been filed. There is, therefore no impediment to the grant of the relief. 8.

In view of the material placed on record, the Petition is accepted and proclamation is dispensed with and the petition is allowed in terms of prayer clause (a) which reads thus:

"(a) The Legal Heirship Certificate be issued Certifying that Minesh Pravin Vora Petitioner along with Jaywanti Pravin Vora Wife of the deceased, Urmi Rusabh Shah and Meeta Latesh Shah, 2 Daughters of the deceased as mentioned above are only Heirs and Legal Representatives of the Deceased under the provision of Bombay Regulation Act VIII of 1827."
