When the matter is called out, Mr. Parshurami, learned AGP appears for the Respondent-State and submits that against the award a Petition under Section 34 of the Arbitration and Conciliation Act, 1996 was filed, however, the same came to be rejected under Rule 986 and although there is no stay on the execution of the award, this Court may grant some time.

1152. N 17-26 in COMEX 215-25.doc on the execution of the award and no explanation having been furnished by the Judgment Debtor as to how the award would be satisified, this Court may make the Notice under Order XXI Rule 22 of the Code of Civil Procedure, 1908 absolute.

Having heard the learned Counsel and having considered the submissions, this Court is of the view that the Notice under Order XXI Rule 22 of the Code of Civil Procedure, 1908 be made absolute and is hereby made absolute.
