By this Chamber Order the Plaintiff applies for substituted service of writ of summons upon the Defendant No. 1 viz. Mohan Manohar Mule.

Perused the affidavit in support. The Applicant has stated in the affidavit in support that, the writ of summons sent for service upon the Defendant No. 1 through Sheriff of Bombay was returned back with remark "insufficient address, returned to sender". The bailiff of Sheriff of Bombay has also filed an affidavit of service dated 17th December 2025. The same is already on record. 3.

Heard. The Ld. Advocate for the Applicant. Ld. Advocate for the Applicant submits that, the Applicant / Plaintiff be permitted to serve the writ of summons upon the Defendant No. 1 by way of substituted service by publishing the writ of summons in two newspapers viz. "Free Press Journal" in English language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai and Kharghar, Navi Mumbai.

For the reasons stated in the affidavit in support the Chamber Order is allowed and the same is signed separately.

Applicant / Plaintiff to publish the writ of summons in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai and Kharghar, Navi Mumbai within two weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the writ of summons is published within a week thereafter.
