By this Chamber Order the Applicant seeks permission to serve the citation upon (1) ALL CONCERNED (2) Shri Satish Raghuveer Govekar (3) Ms. Alka Asbe (4) Shri Sanjay Raghuveer Govekar and (5) Shri Mahesh Keshav Govekar, legal heirs of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Lokmat" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the deceased died as issueless, the husband and parents of the deceased and parents of the husband of the deceased are predeceased the deceased. It is further stated that, the deceased after the demise of her husband left her matrimonial home and started residing with the Petitioner family till her demise and no one from her husband side ever visited nor is aware about their whereabouts. It is further stated that, he is not aware of the

whereabouts any of the legal heirs of the husband of the deceased and he has made inquiry with the neighbours, friends, relatives, family members and other heirs or community, leaders, religious priest at native place but no one is aware of their whereabouts. It is further stated that, they never visited the deceased during her lifetime or her funeral or never attended family functions and social gathering and they have not been in touch with them more than 20 years. It is further stated that, the deceased had three brothers and one sister who name Kusum Shantaram Govekar died as spinster in the year 1974 and out of three brothers two have expired.

It is further stated that, only surviving brother is Petitioner herein (a) Shri Raghuveer Shantaram Govekar died in the year 1978 as widower leaving behind two sons and one daughter (b) Keshav Shantaram Govekar had one son and no daughter and since last more than 10 year they are not in touch with the Petitioner. It is further stated that, the Applicant is not aware of the present whereabouts of the legal heirs of the deceased. The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Lokmat" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the deceased died as issueless, the husband and parents of the deceased and parents of the husband of the deceased are predeceased the deceased. Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Lokmat" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of citation upon 1) ALL CONCERNED (2) Shri Satish Raghuveer Govekar (3) Ms. Alka Asbe (4) Shri Sanjay Raghuveer Govekar and (5) Shri Mahesh Keshav Govekar, legal heirs of the deceased within four weeks from the date of uploading

this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter. 6.
