The present Chamber Order is e-filed by the applicant for setting aside Order dated 05.08.2025, rejecting captioned Caveat under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that most of the office objection were complied with, however, one objection could not be complied with due to Diwali Vacation. It is further contended that delay of 59 days caused in filing present Chamber Order, which was not intentional. Ld. Advocate for the applicant submits that now all objections are complied with and prays for restoration of the Caveat by condoning delay.

Ld. Advocate for the petitioner objects present Chamber Order and prays for rejection of the same.

Considering grounds raised in the Affidavit, it appears that the applicant had taken efforts for removal of office objections. Therefore, in my view, the applicant should get one opportunity to pursue with captioned Caveat.

No prejudice would cause to the petitioner since the petitioner can contest matter on its own merits. Moreover, substantial justice cannot be denied on technical grounds.

Hence, in the interest of justice, delay of 59 days caused in filing present Chamber Order is

The caveator to remove office objections, if any, of Caveat and get the same registered and/or numbered by filing/uploading compliance praecipe within two weeks from the date of uploading of order, failing Caveat to stand rejected for non-compliance of O.S.Rule 986.
