By this Chamber Order the Applicant seeks permission to serve the citation upon Roncy L. D'Souza, son-in-law of the deceased i.e. husband of predeceased daughter Josephine Dias by way of substituted service as per schedule annexed to the Chamber Order. 2.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the legal heirs of Roncy L. D'Souza who is son-in-law of the deceased is not known to the Applicant / Petitioner. It is further stated that, the Applicant had made diligent search but he could not find and his whereabouts are not known. It is further stated that, he had made inquiries about the son-in-law of the deceased to their relatives and neighbors but could not traceable. The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the legal heirs of Roncy L. D'Souza who is son-in-law of the deceased is not known to the Applicant / Petitioner. She further submits that, the Applicant had made diligent search but he could not find and his whereabouts are not known. She further submits that, he had made inquiries about the son-in-law of the deceased to their relatives and neighbors but could not traceable. She further submits that, the daughter of the deceased Josephine Romeo Dias alias Josephine Roncy D'Souza, daughter of the deceased died on 22nd September 2023 as issueless. She further submits that, whereabouts of her husband Roncy L. D'Souza is not known to the Applicant. She, therefore, prays that, the Chamber Order be allowed. 5.

Perused para 4 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navbharat" in vernacular language i.e. Hindi, widely circulated in Mumbai, by way of substituted service of citation upon Roncy L. D'Souza, son-in-law of the deceased within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
