The present Chamber Order is e-filed by the applicant for setting aside Order dated 16.09.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that the applicant has misplaced the original Will and applied to the Sub-Registrar for issuance of certified true copy. Ld. Advocate for the applicant made a statement that as on date, captioned Petition is uncontested. Statement is accepted.

Office informed that there is delay of 92 days in filing present Chamber Order. Ld. Advocate submits that aforesaid delay caused, is not intentional and prays for condonation.

Reasons mentioned in Affidavit, appear to be genuine and substantial justice cannot be denied on technical ground. However, it would be just and proper to impose certain cost on the applicant so that the applicant would be more diligent in pursuing with the matter. Hence, in the interest of justice, delay of 92 days caused in filing present Chamber Order is condoned and present Chamber Order is granted as prayed subject to payment of cost of Rs. 5,000/- to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India, Mumbai (Main) Branch, Account No. 000120110001337, IFSC CODE :

BKID0000001.
