The present Chamber Order is e-filed by the applicant for setting aside Order dated 04.04.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that the applicant being senior citizen of 83 years old, he was not keeping well, and therefore, he did not contact to his Advocate. It is further contended that for the same reasons delay of 248 days caused in filing present Chamber Order, which was not intentional. Ld.

Advocate for the applicant made a statement that as on date, captioned Petition is uncontested. Statement is accepted.

Office informed that there is delay of 248 days in filing present Chamber Order. Ld. Advocate submits that for the aforesaid reasons, delay is caused, which was not intentional and prays for condonation of the same.

Considering grounds, I am of the view the applicant should get one opportunity to pursue with captioned Petition. Moreover, captioned Petition is uncontested as stated by ld. Advocate for the applicant. Hence, in the interest of justice, delay of 248 days caused in filing present Chamber Order is condoned and the present Chamber Order is granted as prayed.

The petitioner to remove office objections of Petition and get the same registered and/or numbered by filing compliance praecipe
