By this Chamber Order the Applicant seeks permission to serve the citation upon (1) Maruti Jairam More, brother of the deceased, (2) Kamlabai alias Saraswati Gangaram Salvi, Sister of the deceased, and (3) Chandrabai Jairam More, mother of the Deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, deceased died as spinster. It is further stated that, the deceased died leaving behind two brothers and one sister and one brother Bhimrao Jairam More has expired and his whereabouts are not known to the Applicant. It is further stated that, the sister of the deceased Kamlabai alias Saraswati Gangaram Salvi has died issueless and the husband of Kamlabai alias Saraswati Gangaram Salvi has also expired. It is further stated that, Chandrabai Jairam More predeceased the deceased and Petitioner

has made diligent search for the abovenamed legal heirs of the deceased but yet whereabouts are not known. The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, deceased died as spinster. He further submits that, the deceased died leaving behind two brothers and one sister and one brother Bhimrao Jairam More has expired and his whereabouts are not known to the Applicant. He further submits that, the sister of the deceased Kamlabai alias Saraswati Gangaram Salvi has died issueless and the husband of Kamlabai alias Saraswati Gangaram Salvi has also expired. He further submits that, Chandrabai Jairam More predeceased the deceased and Petitioner has made diligent search for the abovenamed legal heirs of the deceased but yet whereabouts are not known. He, therefore, prays that, the Chamber Order be allowed.

Perused para 9 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of citation upon (1) Maruti Jairam More, (2) Kamlabai alias Saraswati Gangaram Salvi, and (3) Chandrabai Jairam More, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
