When the matter is called out, the learned Court Associate informs that the Notices issued by this Court to the Plaintiffs No. 1 and 2 have been served on 18th March, 2026, however, Notice to the Plaintiff No. 3 has been returned unserved with the remark "Addressee left without instructions".

Mr. Shah, learned Counsel appears for the Defendant and submits that in view of the paragraph 4 of the order dated 5th February, 2026, this Court may dismiss the Suit.

However, Ms. Solanki, learned Counsel appears and submits that the Chamber Order for discharge is listed tomorrow before the Prothonotary & Senior Master and this Court may consider the same before passing orders.
