By this Chamber Order, the Applicant seeks permission to serve the citation upon ALL CONCERNED legal heirs of the deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Perused the affidavit in support and additional affidavit. The Applicant has stated in the affidavit that, the deceased died as issueless. It is further stated in the additional affidavit that, wife of the deceased predeceased the deceased and the Applicant has not seen or met any relatives of the deceased visiting his residence even when the parents of the deceased were alive. It is further stated that, at the time of the demise of the wife of the deceased and deceased himself no family members were present. It is further stated that, after the demise of the deceased she took due search for the details of the relatives of the deceased but after due and diligent

search the Applicant could not find any details and also several inquiries were made with other friends and well-wisher of the deceased about the whereabouts of the family members but no one is aware of the deceased having any relatives. The Applicant, therefore, requested to permit her to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the deceased died as issueless. He further submits that, wife of the deceased predeceased the deceased and the Applicant has not seen or met any relatives of the deceased visiting his residence even when the parents of the deceased were alive. He further submits that, at the time of the demise of the wife of the deceased and deceased himself no family members were present. He further submits that, after the demise of the deceased she took due search for the details of the relatives of the deceased but after due and diligent search the Applicant could not find any details and also several inquiries were made with other friends and well-wisher of the deceased about the whereabouts of the family members but no one is aware of the deceased having any relatives. He, therefore, prays that, the Chamber Order be allowed.

Perused the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of citation upon ALL CONCERNED legal heirs of the deceased

within six weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
