The present Chamber Order is e-filed by the applicant for setting aside Order dated 02.09.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that all office objections were complied with and file was ready to upload, but in the meantime, time expired due to which captioned got rejected.
It is further contended that there is delay of 148 days caused in filing present Chamber Order and it was caused since clerk to whom work was assigned to lodge Chamber Order, did not file and respond to Advocate on record. Therefore, it is prayed that captioned Petition may be allowed by condoning delay.
Ld. Advocate for applicant made a statement that as on date, captioned Petition is uncontested. Statement is accepted.
Grounds mentioned in Affidavit appear to be genuine and substantial justice cannot be denied on technical grounds. Hence, in the interest of justice, delay of 148 days caused in filing present Chamber Order is condoned and the present Chamber Order is granted as prayed.
The petitioner to remove office objections of Petition and get the same registered and/or numbered by filing compliance praecipe within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
