By this Chamber Order the Applicant seeks permission to serve the citation upon ALL CONCERNED legal heirs of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in four newspapers viz. "Financial Express" in English Language and in "Munsif" in vernacular language i.e. Urdu, widely circulation at Hyderabad and "Indian Express" in English Language and in "Makhdoom" in vernacular language i.e. Urdu, widely circulation at Ahilya Nager, in the State of Maharashtra. 3.
Perused the affidavit in support and additional affidavit. The Applicant has stated in the affidavit that, the deceased died as bachelor and left behind no brother and sister and parent and grandparents of the deceased predeceased the deceased. It is further stated that, he is not aware of the legal heirs of the deceased. It is further stated in the additional affidavit that, due and diligent search and inquiry was made at Hyderabad as well as at Ahilya Nagar with the neighbors, members of the Society and other

persons who were acquitted with the deceased with a view to ascertain whether the said deceased has left behind any legal heirs, but the he could not find any legal heirs of the deceased. The Applicant, therefore, requested to permit him to publish the citation in four newspapers viz. "Financial Express" in English Language and in "Munsif" in vernacular language i.e. Urdu, widely circulation at Hyderabad and "Indian Express" in English Language and in "Makhdoom" in vernacular language i.e. Urdu, widely circulation at Ahilya Nagar, in the State of Maharashtra.

Heard. Ld. Advocate for the Applicant submits that, the deceased died as bachelor and left behind no brother and sister and parent and grandparents of the deceased predeceased the deceased. He further submits that, the Applicant is not aware of the legal heirs of the deceased. He further submits in the additional affidavit that, due and diligent search and inquiry was made at Hyderabad as well as at Ahilya Nagar with the neighbors, members of the Society and other persons who were acquitted with the deceased with a view to ascertain whether the said deceased has left behind any legal heirs, but the he could not find any legal heirs of the deceased. He, therefore, prays that, the Chamber Order be allowed. 5.
Perused para 9 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in four newspapers viz. "Finance Express" in English Language and in "Munsif" in vernacular language i.e. Urdu, widely circulation at Hyderabad and "Indian Express" in English Language and in "Makhdoom" in vernacular language i.e. Urdu, widely circulation at Ahilya Nagar, in the State of Maharashtra, by way of substituted service of citation upon ALL

CONCERNED legal heirs of the deceased within six weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
