By this Chamber Order the Applicant seeks permission to serve the citation upon ALL CONCERNED legal heirs of the deceased by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Urdu Times" in vernacular language i.e. Urdu, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the deceased died as bachelor. It is further stated in the additional affidavit that, there are no other legal heirs of the deceased and the Applicant had made inquiry with local acquaintance and the person known to the deceased during his lifetime, however, no details of any relatives are legal heirs could be ascertained. It is further stated that, he had made inquiries with friends, relatives and neighbors about the address of the legal heirs of the deceased none of them were able to tell the whereabouts of

the legal heirs of the said deceased. It is further stated that despite due and diligent efforts made by the Applicant , the whereabouts are not known. The Applicant, therefore, requested to permit him to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Urdu Times" in vernacular language i.e. Urdu, widely circulated in Mumbai.

Heard. Ld. Advocate for the Applicant submits that, the deceased died as bachelor. He further submits that, there are no other legal heirs of the deceased and the Applicant had made inquiry with local acquaintance and the person known to the deceased during his lifetime, however, no details of any relatives are legal heirs could be ascertained. He further submits that, he had made inquiries with friends, relatives and neighbors about the address of the legal heirs of the deceased none of them were able to tell the whereabouts of the legal heirs of the said deceased. He further submits that, despite due and diligent efforts made by the Applicant, the whereabouts are not known. He, therefore, prays that, the Chamber Order be allowed.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Urdu Times" in vernacular language i.e. Urdu, widely circulated in Mumbai, by way of substituted service of citation upon ALL CONCERNED, legal heirs of the deceased within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
