By this Chamber Order, the Applicant seeks liberty to serve the citation upon (1) Elizabeth Castelino, Granddaughter of the deceased, (2) Clare Monica Castelino, Granddaughter of the deceased, by way of substituted service as per schedule annexed to the Chamber Order.

Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai.

Perused the affidavit in support. The Applicant has stated in the affidavit that, the wife of the deceased died on 15th May 2000 and the deceased had three sons viz. George Castelino, Edwin Castelino and Anthony Valentine Castalino. It is further stated that, the said Anthony Valentine Castalino had leaving behind two daughters viz. Elizabeth Castelino and Clare Monica Castalino whose whereabouts are not known to the Applicant. It is further stated that, after the death of the deceased since 2000 all legal heirs were separated and there were no communication of the legal heirs

with each other and the Applicant had made inquiry to find out the whereabouts of the legal heirs of the deceased but could not trace out their names or whereabouts. The Applicant, therefore, requested to permit her to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai. 4.

Heard. Ld. Advocate for the Applicant submits that, the wife of the deceased died on 15th May 2000 and the deceased had three sons viz. George Castelino, Edwin Castelino and Anthony Valentine Castalino. She further submits that, the said Anthony Valentine Castalino had leaving behind two daughters viz. Elizabeth Castelino and Clare Monica Castalino whose whereabouts are not known to the Applicant. She further submits that, after the death of the deceased since 2000 all legal heirs were separated and there were no communication of the legal heirs with each other and the Applicant had made enquiry to find out the whereabouts of the legal heirs of the deceased but could not trace out their names or whereabouts. She further submits that, the Applicant be permitted to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai. She, therefore, prays that, the Chamber Order be allowed.

Perused para 9 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of citation upon (1) Elizabeth Castelino,

Granddaughter of the deceased, (2) Clare Monica Castelino, Granddaughter of the deceased, within four weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter. 6.
