CHOL/259/2026 IN TP(L)/15912/2024 P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 01.08.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended therein that vide conditional Order dated 01.08.2025, Applicant was directed to remove office objections within four weeks. On 18.08.2025, Ld. Advocate removed some of the office objections. However, due to inadvertence on the part of junior Advocate, Death Certificate could not be submitted within time and matter got rejected. It is further averred in Affidavit in support that due to aforesaid reasons, he could not file Chamber Order within time and hence, delay of 108 days is caused in filing present Chamber Order.
Ld. Advocate for the Applicant submits that now, he will pursue captioned Petition diligently and therefore, prays that delay of 108 days caused in filing present Chamber Order may be condoned and Chamber Order may be granted.
In view of above, I am of the view that the Applicant has made out a case for restoration of captioned Petition and hence, captioned Chamber Order is granted as prayed by condoning delay of 108 days caused in filing Chamber Order.
