25. CHOL/265/2026 IN EXA(L)/3914/2023 P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 08.01.2026, rejecting captioned Application under O.S. Rule 986 for non-compliance of office objections.

Affidavit of Service dated 06.05.2026 is taken on record. Respondent refused to accept the service of Chamber Order which is a good service.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support of the Chamber Order. It is contended therein that in view of order dated 08.01.2026, two weeks time was granted to remove office objections and to get the Execution Application numbered. However, office objections could not be removed within time and the matter got rejected.

Ld. Advocate for the Applicant submits that now she will pursue the matter diligently and hence, captioned Application may be restored to file. Reason mentioned in the Affidavit, remains uncontested for want of resistance from the respondents. Therefore, Applicant should get one opportunity to pursue with the captioned Petition. In view thereof, the present Chamber Order is granted as prayed subject to payment of cost of Rs. 2,500/-, to be paid to the 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India Mumbai (Main) Branch, Account No. 000120110001337, IFSC Code :

BKID0000001, within one week from today.

Upon payment of cost as mentioned above, the Applicant to remove office objections on the Application and get the same registered and/or numbered within two weeks from the date of payment of cost, failing the Application to stand rejected for non-compliance of office objections under O.S.Rule 986.
