The present Chamber Order is filed by the applicant for setting aside Order dated 24.04.2025, rejecting captioned Suit under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that Leave Petition was allowed by the Hon'ble Court vide Order dated 19.01.2026 by which four weeks time was granted, however, plaintiff failed to tender copy of order due to which office objections could not be complied with within given time. Ld. Advocate submits that now she will pursue with captioned Suit diligently and prays for restoration of captioned Suit.

Advocate for defendant nos. 1 to 4 submitted for passing suitable orders.

Considering grounds in the Affidavit and submission of ld. Advocate for defendant nos. 1 to 4, I am of the view that one opportunity is required to be given to the applicant to pursue with suit. However, it would be just and proper to impose certain cost on the plaintiff, so that, the plaintiff would be more diligent in pursuing with the suit. Hence, in the interest of justice, present Chamber order is granted as prayed subject to payment of cost of Rs.

2,500/- to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India, Mumbai (Main) Branch, Account No.
