30. CHOL/278/2026 IN WP(L)/20601/2024 P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 07.01.2026, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for Petitioner submits that he has served copy of Chamber Order upon other side. Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended therein that vide conditional Order dated 07.01.2026, Applicant was directed to remove office objections within two weeks. However, as Ld. Advocate for the Petitioner was not aware of the said conditional order, matter got rejected due to non compliance of office objections.

Ld. Advocate for the Applicant submits that now, he will pursue with the captioned Petition diligently and therefore, prays that the present Chamber Order may be granted.

Reasons mentioned on oath, as above, appears to be bonafide, and substantial justice cannot be denied on technical grounds. Hence, present Chamber Order is granted as prayed upon payment of cost of Rs. 5,000/- to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India Mumbai (Main) Branch, Account No. 000120110001337, IFSC Code :

BKID0000001, to be paid within one week.
