The present Chamber Order is filed by the applicant for setting aside Order dated 19.12.2025 r/w. Orders dated 02.01.2026 and 16.01.2026, rejecting captioned Interim Application under O.S.Rule 986 for noncompliance of office objections. Ld. Advocate for the applicant made a statement that respondents are served with the Chamber Order and tenders Affidavit of Service, which is taken on record. Despite service, none appeared for the respondents.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that in the present matter, Suit was numbered and the applicant was directed to go through the papers and attend minor office requirements.

Thereafter, the applicant was under impression that Interim Application would be numbered.

Then, matter was time and again listed before the Hon'ble Court. When the applicant attempted to move Interim Application before the Hon'ble Court, the applicant learnt about rejection of the same. Ld. Advocate submits that rejection of Interim Application is technical in nature and requests for restoration of the same.

Grounds mentioned in Affidavit appear to be genuine and substantial justice cannot be denied on technical grounds. Further, contentions raised in Affidavit remain uncontested for want of resistance on the part of respondents. Therefore, I do not hesitate to rely on the same for the purpose of restoration

The applicant to remove office objections of Interim Application and get the same registered and/or numbered by filing/ uploading compliance praecipe within a week from the date of uploading of order, failing Application to stand rejected for noncompliance of office objections under O.S.Rule 986.
