By this Chamber Order, the Applicant/Plaintiff seeks liberty to serve the Writ of Summons upon (1) Pranam Developers, Defendant No. 1 and (2) Deepshal Co-Operative Housing Society Ltd., Defendant No. 4, by way of substituted service by publishing Writ of Summons as per schedule annexed to the Chamber Order. 2.
Perused the Affidavit in support. Heard. Ld. Advocate for the Applicant submits that, the writ of summons sent for service upon the abovenamed Defendant No. 1 and 4 through Sheriff of Bombay could not be served and the same were returned by the postal authority with remark "Addressee left" and "insufficient address" respectively. He, therefore, prays that, the Chamber Order be allowed and the Applicant / Plaintiff be permitted to publish the Writ of Summons in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service of Writ of Summons upon abovenamed Defendant Nos. 1 and 4. Affidavit of service filed by the bailiff of Sheriff of Bombay. 3.
For the reasons mentioned in the affidavit in support the Chamber Order is allowed and the same is signed separately.

Applicant / Plaintiff is directed to publish the Writ of Summons in two newspapers viz. "Free Press Journal" in English Language and in "Navshakti" in vernacular language i.e. Marathi, widely circulated in Mumbai, by way of substituted service upon abovenamed Defendant Nos. 1 and 4 within two weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the writ of summons is published within two weeks thereafter. 4.
Registry is directed to issue fresh Writ of Summons, if required.
