The present Chamber Order is e-filed by the applicant for setting aside Order dated 09.12.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that objection with regard to original death certificate could not be complied with since the same was not traceable. It is further contended that later on it was traced out, however, time granted to remove office objections was over. Ld.
Advocate submits that there is delay of 3 days in filing Chamber Order, which was not intentional. Ld. Advocate made a statement that as on date, captioned Petition is uncontested.
Statement is accepted.
Accordingly, it is submitted that captioned Petition may be restored to file by condoning delay.
Considering grounds in the Affidavit, I am of the view that the applicant should get one opportunity to pursue with captioned Petition. So also, substantial justice cannot be denied on technical ground. Hence, I consider present Chamber Order favourably. In view thereof, Chamber Order is granted as prayed.
The petitioner to remove office objections of Petition and get the same registered and/or numbered by filing/ uploading compliance praecipe within a week from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
