26. CHOL/319/2026 IN EXA(L)/243/2025 P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 12.02.2026, rejecting captioned Application under O.S. Rule 986 for non-compliance of office objections.

Affidavit of Service is filed on record. It appears that Respondent No. 2 is served with Chamber Order, however, Respondent No. 3 refused to accept the service of Chamber Order which is a good service.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support of the Chamber Order. It is contended therein that the cost was duly paid in compliance to Order dated 12.02.2026, however, they failed to file compliance praecipe within time and the matter got rejected.

Ld. Advocate for the Applicant submits that now he will pursue the matter diligently and hence, captioned Application may be restored to file. Reasons mentioned in the Affidavit in Support appears to be bonafide, and substantial justice cannot be denied on technical grounds. Hence, the present Chamber Order is granted as prayed and signed separately.

Applicant to remove office objections on the Application and get the same registered and/or numbered within one weeks from the date of uploading of order, failing the Application to stand rejected for non-compliance of office objections under O.S.Rule 986.
