CHOL/324/2026 IN P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 02.12.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
TP(L)/33667/2024 Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended therein that vide conditional Order dated 02.12.2025, Applicant was directed to remove office objections within two weeks. The Petitioner was not aware of the said conditional order and office objections remained to be removed. It is further averred in Affidavit in support that due to aforesaid reasons, he could not file Chamber Order within time and hence, delay of 54 days is caused in filing present Chamber Order.
Ld. Advocate for the Applicant submits that now, he will pursue captioned Petition diligently and therefore, prays that delay of 54 days caused in filing present Chamber Order may be condoned and Chamber Order may be granted.
In view of above, I am of the view that the Applicant has made out a case for restoration of captioned Petition and hence, captioned Chamber Order is granted as prayed by condoning delay of 54 days caused in filing Chamber Order.
The Petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date .... 2
