CHOL/342/2026 IN P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 02.12.2025, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

TP(L)/35253/2024 Heard Ld. Advocate for the Applicant. Perused Affidavit in support of the Chamber Order. It is contended therein that vide conditional Order dated 02.12.2025, Applicant was directed to remove office objections within two weeks. Due to unavoidable circumstances, the Petitioner could not race and locate original Will of the deceased and there was also office objections with regard to translation, which took considerable time and in the meantime, matter got rejected. It is further averred in Affidavit in support that there is delay of 79 days in filing present Chamber Order.

Ld. Advocate for the Applicant submits that now, he will pursue captioned Petition diligently and therefore, prays that delay of 79 days caused in filing present Chamber Order may be condoned and Chamber Order may be granted.

In view of above, I am of the view that the Applicant has made out a case for restoration of captioned Petition and hence, captioned Chamber Order is granted as prayed by condoning delay of 79 days caused in filing Chamber Order.

The Petitioner to remove office objections on the Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing Petition to stand .... 2
