By this Chamber Order, the Applicant seeks permission to serve the citation upon (1) Neelam Singh, niece of the deceased and (2) Neha Singh, Niece of the deceased, by way of substituted service as per schedule annexed to the Chamber Order. 2.
Perused the schedule. The Applicant applies for publication of citation in two newspapers viz. "Free Press Journal" in English Language and in "Dainik Bhaskar" in vernacular language i.e. Hindi, widely circulated in Mumbai and Uttar Pradesh. 3.
Perused the affidavit in support. The Applicant has stated in the affidavit that, the citation sent for service through the bailiff was returned with remark "Left without instruction". The Applicant, therefore, requested to permit her to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Dainik Bhaskar" in vernacular language i.e. Hindi, widely circulated in Mumbai and Uttar Pradesh.

Heard. Ld. Advocate for the Applicant submits that, the deceased died as issueless. He further submits that, the citation sent for service through the bailiff was returned with remark "Left

without instruction". He further submits that, the bailiff of Sheriff of Bombay has filed an affidavit of service dated 19th November 2025. He further submits that, the husband of the deceased died on 25th November 1991 and parents of the husband of the deceased predeceased the deceased. He further submits that, the deceased had only one brother-in-law viz. Avadh Narayansingh predeceased the deceased and his wife Girija Singh also died and the said brother-in-law had four daughters and no sons. He, therefore, prays that, the Chamber Order be allowed.

Perused para 8 of the Petition. For the reasons mentioned in the affidavit in support the Chamber Order is allowed. Applicant to publish the citation in two newspapers viz. "Free Press Journal" in English Language and in "Dainik Bhaskar" in vernacular language i.e. Hindi, widely circulated in Mumbai and Uttar Pradesh, by way of substituted service of citation upon (1) Neelam Singh, niece of the deceased and (2) Neha Singh, Niece of the deceased within six weeks from the date of uploading this Order. Applicant to file the affidavit of publication once the citation is published within two weeks thereafter.
