The present Chamber Order is e-filed by the applicant for setting aside Order dated 17.12.2025 r/w Order dated 31.12.2025, rejecting captioned Petition for noncompliance of office objections under O.S.Rule 986.
Heard ld. Advocate for the applicant. Perused Affidavit in Support and Additional Affidavit. It is contended that office objections were complied with within given time i.e. on 13.01.2026., however, due to technical issue corrected file of the Petition was not consumed in C.I.S. It is further contended that delay of 25 days caused in filing present Chamber Order, was not intentional. Therefore, it is prayed that present Chamber Order may be allowed by condoning delay.
Considering grounds raised in the Affidavit, I am of the view that the applicant has made out a case for restoration of captioned Petition. Hence, in the interest of justice delay of 25 days caused in filing present Chamber Order is condoned and present Chamber Order is granted as prayed.
The petitioner to remove office objections, if any, of the Petition and get the same registered/numbered by filing/uploading compliance praecipe within two weeks from the date of uploading of order.
