This Chamber Order has been taken out by the Plaintiff for substituted service of the Writ of Summons upon (1) Sunshine Marble & Tiles Industries, Defendant No. 5; (2) Laxmilal Kanaya Jain, Defendant No. 6; (3) Madanlal R. Sutar, Defendant No. 8, and

(4) Bindesh L. Lodha, Defendant No. 10, as per schedule annexed to the Chamber Order.

Heard. Ld. Advocate for the Applicant / Plaintiff submits that, the writ of summons sent for service upon Defendant Nos. 5, 6, 8 and 10 were returned unclaimed and affidavit of service dated 15th December 2025 was filed by Bailiff of Sheriff of Bombay. She further submits that, by an Order dated 8th January 2026 Ld. Prothonotary & Senior Master, directed the Plaintiff to take steps to serve the writ of summons upon abovenamed Defendants.

Perused the affidavit in support. For the reasons stated in the affidavit in support the Chamber Order is allowed and the same is signed separately. Plaintiff is directed to serve the writ of summons upon the Defendant Nos. 5, 6, 8 and 10 by way of

: 2 :

substituted service as per the modes mentioned in the schedule annexed to the Chamber Order within four weeks from the date of uploading this Order. Applicant to file affidavit of service within a week thereafter.
