The amount lying in the estate account of the insolvent is only Rs.914, whereas the debts are more than Rs.3.5 lakhs. The matter is pending for last 20 years and no details have been furnished by the petitioning creditor till today.

The Official Assignee's Report further states that there are no properties available which belongs to the insolvent for recovery. 3.

In view thereof, no purpose would be served in pursuing this petition. Therefore, Official Assignee is directed to transfer Rs.914 to the unclaimed dividend capital account as per Rule 178 of the Presidency Town Insolvency Rules, 1910 and closed the account for all administrative purpose.
