The Official Liquidator has, by way of the present report, sought the following directions:
"a) In view of para (8) of this report, whether this Hon'ble Court be pleased to dispense with the filing of Half yearly Accounts and Final Account by the Official Liquidator as required under Rule 298 of the Companies (Court) Rules, 1959;
b) In view of para (9) of this report, whether this Hon'ble Court may be pleased to permit the Official Liquidator to transfer the said amount of Rs.2,944/- (Rupees Two Thousand Nine Hundred Forty Four only) lying to the credit of the Company (In Liquidation) to the "Companies Liquidation Account" known as Public Account of India in terms of Section 555 of the Companies Act, 1956 read with rule 283 of the Companies (Court) Rules, 1959;
2/4 c) In view of para (13) of this report, whether this Hon'ble Court may be pleased to consider it being just and reasonable to order dissolution of the company viz. Blue Ridge Hotels Private Limited (In Liquidation) under section 481(1) of the Companies Act, 1956 as the Official Liquidator cannot further proceed with winding up of the company for want of funds and assets;
d) In view of para (14) of this report, whether this Hon'ble Court may be pleased to permit the Official Liquidator to preserve the papers/files of the Liquidator pertaining to Blue Ridge Hotels Private Limited (In Liquidation) as required under Section 550 (2) of the Companies Act, 1956 i.e. five years from the dissolution of the Company (In Liquidation);
e) That in view of para (15) stated hereinabove, in case at a later stage if any objection is received from any of the creditors of the Company (In Liquidation), whether this Hon'ble Court may be pleased to permit the Official Liquidator to file necessary report seeking dissolution of the Company (In Liquidation) as void under Section 559 of the Companies Act, 1956;"

Ms. Agrawal, learned counsel for the Official Liquidator, has tendered a chart setting out the status of the company in question, which is as follows: Sr.

. Some creditors have filed proceedings which pending before the Hon'ble DRT, Mumbai. these creditors have been served with the present Report.

Ms. Agrawal has very fairly pointed out that, in paragraph 12 of the report, the Official Liquidator has set out the following matters pending before the Debt Recovery Tribunal, Mumbai-II. The details of the same are as under: Sr.

Ms. Agrawal, however, submits that the Official Liquidator is not concerned with those proceedings today, inasmuch as all the assets in question have been handed over to the respective secured creditors mentioned above. Her statement is accepted.

Given this, having due regard to the submissions made, and given that the funds available in the company relate only to Blue Ridge Hotels Pvt. Ltd., as indicated above, in my view, the report would have to be allowed.

The Official Liquidator's Report is accordingly allowed in terms of prayer clauses (a) to (e).
