The Official Liquidator by way of present Report seeks the following directions:

"a) In view of submissions made in paragraph (8) of this report, whether this Hon'ble Court be pleased to rectify the action of the Official Liquidator in appointment of R. I. Jain & Co., Panel Chartered Accountant and further to permit the Official Liquidator to make payment of professional charges out of 'Common Pool Fund Account Company Paid Staff Salary Reserve Fund Account', subject to deductions of applicable taxes; b) In view of submissions made in paragraph (11) of this report, whether

2/3 this Hon'ble Court be pleased to permit the Official Liquidator to invite claims from the creditors / workers under Rule 148 of the Companies (Court) Rules, 1959 by publishing Notice for inviting claims in newspapers, i.e.

"Free Press Journal" (English) and "Navshakti" (Marathi), both published and having publication in Mumbai through the Panel Advertising Agency, and to pay the professional fees of Panel Advertising Agency, out of 'Common Pool Fund Account Company Paid Staff Salary Reserve Fund Account', subject to deductions of applicable taxes, if any; c) In view of submissions made in paragraph (12) of this report, whether this Hon'ble this Hon'ble Court may be pleased to permit the Official Liquidator to appoint the Panel Chartered Accountant for adjudication of the claims of the creditors, and to file list of such admitted claims of creditors with this Hon'ble Court and also permit the Official Liquidator to pay the professional fees of Panel Chartered Accountants as already approved by this Hon'ble Court vide order dated 26.04.

Heard, Ms. Agrawal who points out that in so far as the claim received by the Official Liquidator in respect of one 'Ansa Industrial Estate Co-Op. Society', the same has been admitted by the Official Liquidator and also subsequently paid, the Liquidator seeks ratification of this claim by way of the directions sought in prayer clause 'a' though prayer clause 'a' inadvertently read as 'rectify'.

Ms. Agrawal further submitted that in so far as the other claims are concerned, the Official Liquidator now seeks leave of the Court to invite these claims in respect of Rule 148 of the Companies (Court) Rules, 1959 by way of publishing notice for invitation of claims, as more particularly set out in the

3/3 prayer clause as also for appointment of a Chartered Accountant to adjudicate these claims and file list of such admitted claims before this Court. 4.

Having due regard to the submissions made and having perused the Official Liquidator's Report, I find that the same deserves to be allowed in terms of prayer clauses 'a' to 'c'.
