The Official Liquidator has by way of the present Report sought the following directions:

"(a) That this Hon'ble Court may be pleased to permit the Official Liquidator to make payment to claimant, Shri. Ashok Keshav Yadav as mentioned in Para 13, out of the amount lying to the credit of the second dividend account of said Company @30 paise in a rupee as earlier declared to the other employees of the said Company; (b) That this Hon'ble Court may be pleased to grant permission to the Official Liquidator for closing said dividend account, after payment stated in prayer clause (a) above, more particularly mentioned at Para 11 and Areeb

2/2 31-OLR-84-2026 (OS).DOC transferring the balance amount, to the Registrar of Companies/ RBI under Section 555 of the Companies Act, 1956 as an undistributed assets;" 2.

Having perused the Official Liquidator's Report and having heard, in my view, a case has been made out to allow the Official Liquidator's Report in terms of prayer clause 'a' and 'b', thus the Report is accordingly allowed. [ARIF S. DOCTOR, J.] Areeb
