The Official Liquidator has by the present Report sought the following directions/orders:

"a) In view of averments made in paragraph [11] present report, whether this Hon'ble Court be pleased to confirm the sale in favour of 'Saurabh Mehta' with an amount of Rs.29,000/- (Rupees Twenty Nine Thousand Only) towards Hyundai Santro Xing eRLX MH-43-R-312 and Rs.29,000/- (Rupees Twenty Nine Thousand Only) towards Hyundai Santro Xing eRLX MH-02-AP-4575, both parked at Elder House, Plot No.C9, Jai Mahavir Centre, Salia Industrial Estate, Opposite Veera Desai Road, Andheri (West), Mumbai-400053;

b) Whether this Hon'ble Court would be pleased to permit the Official Liquidator to handover the possession of movable assets (Cars) after receipt of the full sale consideration from successful bidder, as per the terms and

2/3 conditions of Sale Notice;

c) In view of averments made in paragraph [12] present report, whether this Hon'ble Court be pleased to permit the Official Liquidator to make one more attempt to sale the unsold seven Cars either on the same Reserve Price and Earnest Money Deposit, which was approved by this Hon'ble Court by an order dated 28.11.2025 readwith order dated 05.12.2025 passed on Official Liquidator Report No.94 of 2025 or such revised Reserve Price and Earnest Money Deposit as this Hon'ble Court please to refix; d) In view of averments made in paragraph [13] present report, whether this Hon'ble Court be pleased to permit the Official Liquidator to permit the Official Liquidator to upload "Sale Notice" and "Terms and Conditions of Sale" on the website of this Hon'ble Court, Ministry of Corporate Affairs and website of PSB Alliance Private Limited, the Auctioneer agency and place further report before this Hon'ble Court for confirmation of the highest bidder in e-auction;

e) In view of averments made in paragraph [14] present report, whether this Hon'ble Court be pleased to dispense with the publication of Sale Notice in newspaper to avoid expenses towards advertisement, as the Sale Notice is proposed to be uploaded on various sites;

f) In view of averments made in paragraph [15] present report, whether this Hon'ble Court be pleased permit the Official Liquidator to sale the movable asset (skeleton of truck) through local vender as a scrap, which is presently lying at Plot No.D-7/7, Road No.33, Wagle Estate, Thane 400604, subject to confirmation of this Hon'ble Court;" 2.

Ms. Agrawal points out that pursuant to the previous order, the Official Liquidator has now received offers for two of the nine vehicles in question. She submits that the offers received are above the reserve price for two of the vehicles in question namely Hyundai Santro Xing eRLX MH-43-R-312 and Hyundai Santro Xing eRLX MH-02-AP-4575. She however, submits that in so far as the other vehicles are concerned, no offers were forthcoming and therefore seeks leave of the Court to once again attempt to sale the said balance seven vehicles.

Having heard learned counsel and having noted the fact that in so far as two of the vehicles are concerned, offers are received above the reserve price. In my view, the Report would have to be allowed in terms of prayer clauses 'a' to 'e'.

Ms. Agarawal has also at this stage pressed for prayer clause 'f'. On a query put to Ms. Agrawal that the Official Liquidator had not thus qua sought any directions for valuations of the said trucks, photograph of the said trucks were tendered for my perusal, the same shows that the truck "Or what is left" can only be sold as scrap.

Ms. Agrawal has tendered a copy of the valuation report, basis which I fix the reserve price in respect of the skeleton of the said truck at Rs. 4,50,000/-. It is clarified however, given that it is only a skeleton of the said truck, the same may be sold as scrap.
