The Official Liquidator has by way of the present Report sought the following direction/Order:

"a) In view of para (9) of the report, whether this Hon'ble Court may be pleased to permit the Official Liquidator to close the dividend Account bearing No. 0062002100156171 and transfer the dividend amount of Rs.3,70,077/- to the account of the Company (In Liqn.) maintained by the Official Liquidator as the entire claim of Maharashtra State Electricity Distribution Company Ltd. has been paid by the Wasan Realtors Pvt. Ltd. auction purchaser on 07.12.2020."

Heard Ms. Agrawal, learned counsel appearing on behalf of the Official Liquidator, who points out that the Official Liquidator had received three claims, Areeb

2/2 16-OLR-111-2026 (OS).DOC pursuant to notice of payment dated 28 th December, 2020 in respect of Economic Transport of India and Employees State Insurance Corporation (ESIC). The Liquidator has made payment as more particularly set out in paragraph no. 6 of the Official Liquidator's Report. She has then invited my attention to a communication letter dated 6 th January, 2021 addressed to the Official Liquidator by Maharashtra State Electricity Distribution Co. Ltd. (MSEDC) i.e. claimant. She by the said letter points out that Maharashtra State Electricity Distribution Co. Ltd. (MSEDC) has informed the Official Liquidator that there are no outstanding arrears against energy charges payable as per the records of Maharashtra State Electricity Distribution Co. Ltd. (MSEDC). 3.

Ms. Agarwal points out that though the Official Liquidator had responded to the letter vide letter dated 19 th February, 2021 calling upon Maharashtra State Electricity Distribution Co. Ltd. (MSEDC) to file an Affidavit to his effect. However, no Affidavit has been received, in light of the letter which was received by the Maharashtra State Electricity Distribution Co. Ltd. (MSEDC), the dividend account be closed and balance amount in the dividend account be transferred to the Company account in liquidation. 4.

Having due regard to the submissions and having perused the Report, I find that the same would have to be allowed and is accordingly allowed as prayed for. The Official Liquidator's Report is accordingly disposed of. [ARIF S. DOCTOR, J.] Areeb
