It appears that a Commercial Suit has been filed by the Respondent challenging termination notice dated 19 May 2025 as well as questioning validity of some of the clauses to the Retail Business Arrangement Agreement. Applicant has already filed Application under Section 8 of the Arbitration and Conciliation Act, 1996 (Arbitration Act) seeking reference to arbitration in Commercial Suit. In that view of the matter, the present Application is permitted to be withdrawn. As and when the Commercial Court makes a reference to arbitration in the pending Suit, the Applicant would be at liberty to file a fresh Application under Section 11 of the Arbitration Act, in case there is no agreement on the name of the Arbitrator.

The Commercial Arbitration Application is accordingly permitted to be withdrawn and disposed of.
