INTERIM APPLICATION NO. 248 OF 2026 1.
The present Interim Application seeks amendment to the cause title of the plaint and deletion of the name of Plaintiff No. 7 in the Suit, in Notice of Motion No. 10 of 2017, and in Interim Application (L) No. 15266 of 2022 taken out in the Suit, since Plaintiff No. 7 has passed away on 26 th November 2025. There is no opposition to this Interim Application and accordingly, the same is allowed in terms of prayer Clause - (a) and the following order is passed:
:: ORDER::
i) The Plaintiffs are permitted to amend the plaint, ---------------------------------------------------------------------------------------------------------------------------------------------------------------------------------
Notice of Motion No. 10 of 2017 and Interim Application (L) No. 15266 of 2022 in terms of the proposed amendment set out in the schedule annexed to the Interim Application. This amendment shall be carried out, on or before 10th February 2026.
(ii) Re-verification is dispensed with.
(iii) Interim Application is disposed of in terms of the above order.
(iv) There shall be no order as to costs.

Pursuant to the last order, the Plaintiff tenders an Affidavit-ofService dated 2nd February 2026. The same is taken on record. A perusal of this Affidavit shows that service of the Interim Application has been effected on all the Defendants. Insofar as Defendant No. 6 is concerned, by an order dated 15th December 2025, she has already relinquished her share in favour of the other members of her Hindu Undivided Family (H.U.F.). 3.
Ms. Saxena, learned Counsel who appears on behalf of the Plaintiffs, states that she has not yet been in a position to file an appropriate ---------------------------------------------------------------------------------------------------------------------------------------------------------------------------------
application seeking deletion of the name of Plaintiff No. 2 from the array of parties to the present Suit on account of his demise and seeks some time in that regard.
