This Interim Application, seeks restoration of Commercial Suit No. 112 of 2023, filed pursuant to an order dated October 1, 2025, passed by the Learned Single Judge of this Court, permitting such

Interim Application to be filed. It is evident that the Interim Application has been filed within the period of three months as permitted. 2.

There is stringent opposition to the Application on the part of the Respondent. The main contention is that one day before the order dated October 1, 2025, the Learned Single Judge had also imposed costs of Rs.25,000/- per Interim Application, to be paid in terms of paragraph 2 of the order dated September 30, 2025. It is stated that these costs have not been paid and the objections have not been removed. 3.

Since instructions are now being received from the Plaintiffs to pursue the matter, it would be imperative that the payment of costs, as directed in paragraph 2 of the order dated September 30, 2025 is complied with. The restoration is allowed provided proof of payment of costs is provided to the Registry.

Such payment of costs shall be effected no later than a period of two weeks from the upload of this order on the website of this Court. 5.

It is clarified that if the costs are not paid, without any further reference to the Court, the Interim Application would stand dismissed and the proceedings would not stand restored. The captioned Interim Application is disposed of in the aforesaid terms. Chaitanya
