This application is filed for restoration of the arbitration petition which is dismissed for non removal of office objections in view of the common notice dated 26th August 2024, published on the website.

Learned counsel for the applicant submits that he was unaware about the notice. He submits that when an attempt was made for clubbing this petition along with the connected 1/3

arbitration petition, the advocate learnt about the dismissal of the petition in view of the common notice. He, therefore, seeks restoration of the petition.

Learned counsel for the petitioner submits that he shall remove all the office objection within two weeks. 4.

Learned counsel for the respondent opposes the restoration of the petition. She submits that the petition was filed in the year 2023 and the notice was of the year 2024. However, no steps were taken to remove the office objections.

I have perused the papers of the petiton, even in the court record there is no order passed in this petition granting any conditional time. The court record does not refer to the dismissal of the petition in view of the common notice. In this peculiar facts and circumstance of the case, delay is condoned and the application is allowed.

The arbitration petition is restored to file. 7.

The petitioner shall remove office objections within two weeks from today.

The interim application is allowed in the aforesaid terms.

9.

After objections are removed, office shall register the petition and list it for admission.
