This Interim Application seeks restoration of Chamber Order No. 640 of 2025 in Execution application (L) No. 7041 of 2023 that came to be dismissed for default on 8th January, 2026. 2.

Mr. Suraj, learned Counsel appears for the Applicant and submits that the Chamber Order has been filed seeking restoration of the Execution Application that came to be rejected for non-compliance of Rule 986 of the High Court (Original Side) Rules, 1980. 2026.04.10 20:38:13 +0530 submits that, however, when the Chamber Order was listed before the NIKITA YOGESH GADGIL Prothonotary & Senior Master on 8th January, 2026, none had appeared and the Chamber Order came to be dismissed.

Mr. Suraj submits that the Applicant is seeking execution of the money decree dated 7th July, 2011 and that in the interest of justice, this Court may restore the Chamber Order, subject to reasonable terms that this Court may impose.

Having heard the learned Counsel and having considered the submissions, this Court is of the view that the Interim Application be allowed, subject to payment of costs.

Accordingly, subject to payment of costs of Rs. 5000/- to the High Court Law Library, Original Side, within a period of two weeks, the Interim Application is allowed in terms of prayer Clause (a), which reads thus:- "a) Be pleased to restore Chamber Order No. 640 of 2025 to the file of this Hon'ble High Court by setting aside the order dated 08/01/2026 on such terms and conditions as this Hon'ble High Court deem fit and proper."
