This Interim Application seeks deletion of the deceased Plaintiffs no.1 and 2 from the array of parties in the Suit and to implead the successor Trustees as per the schedule as Plaintiffs no.5 and 6. 2.

The learned Counsel appearing in the matter for the Defendants raise only a formal objection.

Having heard the learned Counsel and having considered the submissions and having noted that the Plaintiffs no.1 and 2 have passed away and the two Plaintiffs sought to be brought in are the successor Trustees of the Trust, this Court is of the view that the application be allowed in terms of prayer clause (a) which reads thus : (a) To allow the Applicant herein to delete the name of the Plaintiffs no.1 and 2 from the array of parties in the Suit and to implead the successor Trustees described more particularly in the Schedule hereto.

Let amendment to the plaint and proceedings be carried out within a period of three weeks and the amended proceedings be served in a week thereafter and an appropriate Affidavit of service be filed. 5.

The Interim Application accordingly stands allowed and disposed as above.

List the Suit on 28th April 2026.
