The captioned interim application seeks restoration of the Commercial Arbitration Petition which came to be dismissed for non removal of office objections.
Learned Counsel for the Applicant submits that Respondents are served. Ms Patel, has today entered appearance on behalf of Respondent Nos.1 and 2. Learned Counsel for the Applicant undertakes to file affidavit of service in respect of Respondent Nos.3 to 5.
Ms Patel fairly submitted that there is no opposition to the interim application being allowed.

2/2 5-IA-1968-26.DOC In my view, given that the Petition was dismissed for non removal of office objections and having considered the reasons set out in the interim application, substantive justice would best be served by giving the Applicant one opportunity to remove office objections and urge the petition on merits. Hence, the interim application is allowed in terms of prayer clauses (a) and (b). The office objections to be removed within a period of two weeks from today, failing which, the Petitionn would stand dismissed with costs of Rs.50,000/-.
