The sole objection in this matter was about the challenge to the rejection of an Application under Section 16 of the Arbitration and Conciliation Act, 1996 ("the Act") on the premise that the challenge being belated. By legislative design, the challenge to the rejection of Section 16 Application can only be mounted at the Section 34 stage. 2.

already been disposed of through a mass notice, on the premise that any proceeding in which pending objections remain undisclosed would stand dismissed. Therefore the proceedings had been disposed of even before clarification had been sought and was depicted as being dismissed. 3.

The report dated May 8, 2026 filed by the Prothonotary and Senior Master of this Court is taken on record. In view of the explanation set out therein, namely notice dated August 26, 2024 being the reason for dismissal of these proceedings, it is apparent that by the time this Court's clarification had been sought on February 27, 2025, the underlying proceedings had already been disposed of. Therefore, the Petition is now restored and stood over as aforesaid.

In these circumstances, this being the sole reason for which these proceedings were dismissed, it is made clear that there are no objections pending in this matter. Registry is directed to restore the Commercial Arbitration Petition (L) No.26561 of 2022 by giving it a final registration number and list it on reopening in accordance with the Standard Operating Procedure of this Court.

Stand over to June 12, 2026.
