Interim Application No. 2359 of 2026 :

Interim Application has been preferred seeking restoration of the Arbitration Petition which has been dismissed for non-removal of office objections.

Learned counsel appearing for Respondent would oppose the application and would submit that objections which were raised by the Court was filing of typed copies which has no relationship with the fact that the Applicant is based out of Hyderabad and there is delay. He Sairaj 1 of
19 IA-2359-2026.doc submits that as there is no sufficient cause, the application may not be allowed.

It is not disputed that Arbitration Petition has been dismissed for non-removal of office objections which is the duty of the Advocate on record, particularly, considering that objections raised by the Department was filing of typed copies, which was the responsibility of Advocate on record. For default on the part of the Advocate, the litigant cannot be made to suffer.

In light of above, delay of 19 days caused in preferring the present Application is condoned.
5.
Interim Application is allowed and the Arbitration Petition is restored subject to removal of office objections within period of two weeks from today.

By an order of even date, the Arbitration Petition is restored to file.

Stand over to 1st July, 2026 (hearing).
